zephyr complies with the Protection of Personal Information Act ("POPIA"). This section explains what personal information we collect, why, how long we keep it, and how you exercise the rights POPIA gives you.

What we collect

• From the contact form: your name, email address, firm name, firm size band, an area of interest, and the free-text description of your situation. You provide these voluntarily.
• From the newsletter form: your email address only.
• From correspondence: any information you share by email, phone or in meetings during a prospective or active engagement.
• From the website itself: server logs (IP address, browser type, time of visit) for routine security and reliability monitoring. If you accept analytics cookies, we also use Microsoft Clarity to collect anonymised usage data (pages viewed, clicks, and session activity) — see the Cookies section below. Analytics stays off until you accept.

Why we collect it

• To reply to your enquiry and arrange a discovery call.
• To send you the newsletter you signed up for, if you did.
• To perform the engagement you have asked us to perform.
• To meet our own statutory record-keeping obligations.

We do not sell, rent, or trade your personal information. We do not share it with third parties for marketing.

How long we keep it

• Enquiry data (form submissions): up to twenty-four months from the date of submission, then destroyed.
• Engagement records: seven years from the end of the engagement, in line with general business record retention norms in South Africa. You may request earlier destruction at any time, subject to any specific legal requirements we are bound by.
• Newsletter subscriptions: retained while you are subscribed. Unsubscribing removes you from the active list immediately; backup copies are purged within thirty days.

Your rights under POPIA

You have the right to:

• Be told what personal information we hold about you.
• Request that we correct or delete that information.
• Object to the processing of your information for direct marketing — in our case, that means unsubscribing from the newsletter.
• Lodge a complaint with the Information Regulator ( inforegulator.org.za ) if you believe we have mishandled your information.

Confidentiality during engagement

During a paid engagement, all firm and personal information exchanged is covered by a mutual NDA signed before the diagnostic begins. We do not name clients in marketing or publicly available material without explicit written permission.

Acceptable use

You may read, link to, and quote short excerpts of the published content on this site for non-commercial purposes, with attribution. You may not scrape, mirror, republish in bulk, or use the content to train machine-learning systems without our prior written consent.

Jurisdiction

These terms and any dispute arising from your use of the site are governed by the laws of the Republic of South Africa, and any dispute is subject to the exclusive jurisdiction of the competent courts of KwaZulu-Natal.

Where a client's situation requires regulated advice — personal financial planning, investment portfolio management, tax opinion, legal opinion — we refer to specialists who hold the appropriate regulation and licences, and we do not earn a fee or commission for that referral.

Information published on this site (including the Insights section) is general business advisory commentary, written for an audience of business owners. It is not tailored to your particular firm, and acting on it without first speaking to an advisor who understands your specific situation is not a good idea.

This site does not use cookies for advertising, profiling, or third-party ad tracking, and never sets analytics cookies without your consent.

If you correspond with us by email — whether through the contact form or directly — your email is treated as confidential business correspondence and is not added to any marketing list without your separate consent.

We update this page when something material changes — a new tool is added, a process changes, or the law changes. The version number and "last updated" date at the top of the page are the authoritative record.

Material changes that affect existing subscribers or clients are communicated directly by email, not just by changing the page. Minor wording fixes are not.
